Islamic Will

Full details →A good Islamic estate plan respects both your wishes and your faith. Here is how to judge a service.
The tool must follow Islamic inheritance shares for heirs. It should also let you give up to one-third to charity or non-heirs. Correct math here is the most key feature.
Your will must hold up in court in your province. So pick a service that builds province-compliant forms. Lawyer review is even better.
A full plan covers more than just a will. Look for health care forms, power of attorney, guardian picks, and funeral notes. Some also build trusts for big estates.
Pick a service backed by named scholars or a Shariah review. That signals the Islamic math and wording are right.
If a Muslim in Prince Edward Island dies without a valid will, the estate is distributed by Prince Edward Island's intestacy statute — a fixed legal formula that does not follow the Quranic shares of Faraid. A will executed under Prince Edward Island law is what lets you apply Islamic inheritance instead.
Prince Edward Island's intestacy statute distributes an estate among the surviving spouse, children, parents, and siblings in fixed proportions set by state law. Like every U.S. state, Prince Edward Island does not implement Faraid — for instance, sons and daughters inherit equally under intestacy, and a surviving spouse's share is far larger than the Quranic 1/8 or 1/4. The only way to apply Islamic inheritance in Prince Edward Island is a state-law-valid Islamic will.
Islamic inheritance (Faraid) assigns fixed shares to specified heirs from the estate that remains after funeral costs, debts (including an unpaid mahr), and any permitted bequest (waṣiyyah, up to one-third for non-heirs). No U.S. state intestacy statute reproduces these shares.

|---|---|---|
| HusbandChildren here include a son's descendants. | 1/4 | 1/2 |
| Wife (one or more share equally) | 1/8 | 1/4 |
| Daughter (no sons)With sons present, children take the residue at a 2:1 son-to-daughter ratio (Qur'an 4:11). | 1/2 if sole; 2/3 shared if two or more | — |
| FatherTakes 1/6 plus residue in some configurations. | 1/6 | Residuary (ʿaṣaba) |
| Mother | 1/6 | 1/3 (1/6 if multiple siblings survive) |
| SonInherits what remains after fixed shares; with daughters at a 2:1 ratio. | Residuary (ʿaṣaba) | Residuary (ʿaṣaba) |
Source: Qur'an 4:11–12 (Surah an-Nisa). Standard Sunni fixed shares; specific estates can involve residuary (ʿaṣaba) recalculation, ʿawl/radd adjustments, and school-specific positions — use the Faraid calculator and have your distribution reviewed by a qualified scholar.
The Prophet Muhammad ﷺ said: "It is not permissible for any Muslim who has something to bequeath to stay for two nights without having his Last Will and Testament written and kept ready with him." For Muslim Americans this is doubly important: dying intestate (without a will) hands distribution to a state statute that does not implement Faraid.
Sahih al-Bukhari 2738; Sahih Muslim 1627Qur'an 4:11 instructs that distribution to heirs occurs "after any bequest he may have made or any debt" (min baʿdi waṣiyyatin yūṣī bihā aw dayn). The Quranic shares are therefore calculated on the net estate, not the gross.
Qur'an 4:11All four Sunni schools treat an unpaid mahr as a dayn (debt) owed by the husband to the wife. It is paid from the gross estate before the widow's Quranic share is calculated — but a U.S. probate court can only honor a debt it can verify, which is why a documented, dollar-fixed mahr (typically in an Islamic prenup) matters.

Common questions about islamic estate planning in Prince Edward Island
A step-by-step guide to evaluating islamic estate planning providers
Verify Shariah compliance
Check that the lender has a formal Shariah board. Or look for named scholar review or a third-party badge. Strong Shariah oversight is the best sign of a real halal product.
Compare financing structures
Ask how the deal is set up. Common types are co-ownership, cost-plus, and lease-to-own. Each one has its own risks, costs, and ownership rules.
Check province availability
Some lenders work across every province. Others serve just a few. Make sure the product is offered in your province. And confirm the lender holds the right provincial license.
Evaluate total cost
Do not stop at the headline rate. Add up fees, closing costs, profit margins, and any monthly charges. Ask each lender for a full cost sheet or Good Faith Estimate.
Read customer reviews
Check Google reviews and BBB ratings. Also ask in your local community. Look closely at notes on speed, support, and what happens after closing.
Consult a qualified advisor
Big money calls for two pros. Talk to a halal finance advisor. Also talk to a licensed money pro who knows your full picture.
