Darurah
ضرورة
Pronunciation: dah-ROO-rah
Necessity: a condition under which an otherwise prohibited act becomes temporarily permissible.
Definition
The legal doctrine that genuine necessity lifts a prohibition, derived from Qur'anic verses permitting forbidden food to one who is starving. Jurists set a high bar: the harm avoided must be grave (loss of life, limb, essential livelihood), there must be no permissible alternative, and the exception is limited to what the necessity requires and ends when it does.
A lesser standard, hajah (need), relaxes some rules for widespread hardship. The 1999 European Council for Fatwa and Research ruling permitting mortgages for Muslims in the West invoked these doctrines; most scholars hold they do not apply where halal financing is available.
