Fiqh
فِقْه
Pronunciation: FIQH (fik)
Islamic jurisprudence - the human scholarly effort to derive practical rulings from the Quran and Sunnah, including every ruling on money, contracts, and finance.
Definition
Literally "deep understanding." Fiqh is the body of practical legal rulings that scholars derive from the primary sources (Quran and Sunnah) using recognized methods such as consensus (ijma), analogy (qiyas), and public benefit (maslaha). Shariah is the divine law itself; fiqh is the scholarly interpretation of it, which is why rulings can differ between the four Sunni schools (Hanafi, Maliki, Shafi'i, Hanbali) and across the Shia Ja'fari school. Every verdict you will meet in halal finance - whether a mortgage structure is permissible, how a credit card can be used, when a stock passes screening, how zakat is calculated - is a fiqh ruling, not a direct Quranic text.
Fiqh al-muamalat (jurisprudence of transactions) is the branch covering contracts and finance; AAOIFI's Shariah standards are a modern codification of it. Knowing that a ruling is fiqh explains why two Shariah boards can reach different answers in good faith and why HalalWallet shows the scholarly spread rather than a single yes/no.
